Part 1: Agreement & Eligibility

Introduction

Welcome to FundYourEdge. These Terms of Service ("Terms") constitute a legally binding agreement between you and FundYourEdge, a Wyoming corporation based in Miramar, Florida 33027 ("FundYourEdge," "Company," "we," "us," or "our"). These Terms govern your access to and use of our website (the "Site"), trading evaluation programs, funded trading accounts, and all related services (collectively, the "Services"). By accessing the Site, creating an account, purchasing an evaluation, or using any of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Site or Services. These Terms apply to all users, including visitors, registered users, evaluation participants, and funded traders.

Acceptance of Terms

By accessing or using our Services, you represent and warrant that: (a) You have read and understand these Terms in their entirety; (b) You have the legal capacity to enter into a binding agreement; (c) You are not prohibited from using the Services under applicable law; (d) You will comply with all terms, conditions, and policies referenced herein; (e) All information you provide is accurate, current, and complete. Your continued use of the Services following any modifications to these Terms constitutes acceptance of those changes. We encourage you to review these Terms periodically.

Eligibility Requirements

  • You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is higher)
  • You must not be located in, or a resident of, any jurisdiction where our Services are prohibited or restricted
  • You must not be on any government sanctions list or prohibited persons list
  • You must have a valid government-issued identification document
  • You must provide accurate personal and financial information for identity verification (KYC)
  • You must not have been previously terminated from our Services for rule violations
  • You must have the legal authority to enter into binding contracts

FundYourEdge reserves the right to refuse service, terminate accounts, or cancel orders at our sole discretion, including if we believe you do not meet these eligibility requirements or have violated these Terms.

Part 2: Account & Registration

Account Registration

To access certain features of our Services, you must create an account. When registering, you agree to: (a) Provide accurate, current, and complete information during registration; (b) Maintain and promptly update your account information; (c) Maintain the security and confidentiality of your login credentials; (d) Accept responsibility for all activities under your account; (e) Notify us immediately of any unauthorized access or security breach; (f) Not share, transfer, or sell your account to any third party; (g) Use only one account per person (multiple accounts are prohibited). You are solely responsible for any activity on your account, whether or not authorized by you. FundYourEdge will not be liable for any loss or damage arising from unauthorized use of your account.

Identity Verification (KYC)

FundYourEdge is committed to preventing fraud, money laundering, and other illegal activities. As part of our compliance obligations, we require identity verification ("Know Your Customer" or "KYC") before you can: (a) Receive payouts or withdrawals; (b) Access funded trading accounts; (c) Participate in certain promotional offers. You agree to provide valid government-issued identification, proof of address, and any additional documentation we may reasonably request. Failure to complete verification may result in account restrictions or termination. All personal information is handled in accordance with our Privacy Policy.

Part 3: Evaluation Programs

Trading Evaluation Programs

FundYourEdge offers trading evaluation programs ("Evaluations") designed to assess your trading skills in a simulated environment. Evaluations are educational and assessment tools only; they do not involve real capital or live market execution. By purchasing and participating in an Evaluation, you understand and agree that: (a) All trading occurs in a simulated environment with virtual funds; (b) No real money is at risk during the Evaluation phase; (c) Simulated results do not guarantee future performance in live markets; (d) You must meet specific profit targets and comply with all trading rules; (e) All evaluation fees are non-refundable—no exceptions; (f) Successfully completing an Evaluation does not guarantee a funded account offer.

Trading Rules & Objectives

Each Evaluation program has specific rules, objectives, and parameters that you must follow. These may include, but are not limited to:

  • Profit targets: Minimum profit percentage required to pass
  • Maximum daily loss limits: Maximum allowable loss in a single trading day
  • Maximum total drawdown: Maximum allowable loss from peak account balance
  • Minimum trading days: Required number of active trading days
  • Consistency rules: Requirements for trading consistency and risk management
  • Prohibited trading practices: News trading restrictions, hedging limitations, etc.
  • Position sizing limits: Maximum lot sizes and exposure limits
  • Trading hours: Permitted trading windows and restricted periods

Specific rules for each Evaluation type are provided on our website and in your account dashboard. Violation of any trading rule may result in immediate disqualification without refund. FundYourEdge reserves the right to modify trading rules with reasonable notice.

Evaluation Failure & Disqualification

Your Evaluation will be terminated and considered failed if you: (a) Exceed the maximum daily loss limit; (b) Exceed the maximum total drawdown limit; (c) Violate any trading rule or prohibited practice; (d) Engage in any form of cheating, manipulation, or abuse; (e) Use unauthorized third-party tools, signals, or trade copiers; (f) Attempt to exploit technical glitches or platform errors; (g) Provide false or misleading information; (h) Violate these Terms of Service. As stated in our No Refund Policy, all purchases are final and no refunds will be issued for failed evaluations. You may purchase a new Evaluation or, where available, a discounted reset to try again.

Part 4: Funded Accounts

Funded Trading Accounts

Upon successful completion of an Evaluation and at FundYourEdge's sole discretion, you may be offered a funded trading account ("Funded Account"). Funded Accounts allow you to trade with capital provided by FundYourEdge and share in the net trading profits. By accepting a Funded Account, you understand and agree that: (a) You are an independent contractor, not an employee, partner, or agent of FundYourEdge; (b) You have no ownership interest in the trading capital or FundYourEdge; (c) Profit sharing is subject to our payout terms and your continued compliance; (d) FundYourEdge may modify, suspend, or terminate your Funded Account at any time; (e) All trading must comply with our rules, risk parameters, and applicable regulations; (f) You are solely responsible for your trading decisions and any resulting losses.

Profit Sharing & Payouts

Funded traders are entitled to receive a percentage of net trading profits as performance-based compensation, subject to the following: (a) Profit split percentages are specified in your account agreement and may vary by account type; (b) Payouts are processed according to our published payout schedule; (c) Minimum payout thresholds may apply; (d) All payouts are subject to successful identity verification (KYC); (e) Payouts may be withheld pending review of trading activity for rule compliance; (f) FundYourEdge reserves the right to adjust payouts for trading errors or adjustments; (g) You are responsible for all applicable taxes on amounts received. Payout methods, processing times, and any applicable fees are detailed on our website. FundYourEdge is not responsible for delays caused by third-party payment processors or financial institutions.

Funded Account Termination

Your Funded Account may be terminated immediately and without prior notice if you: (a) Exceed any loss limit or drawdown threshold; (b) Violate any trading rule or risk parameter; (c) Engage in prohibited trading practices; (d) Fail to maintain required trading activity; (e) Breach these Terms of Service; (f) Engage in any fraudulent, illegal, or unethical conduct; (g) Fail to complete required identity verification. Upon termination, any pending payouts may be forfeited and you will lose access to the Funded Account. FundYourEdge's decision regarding termination is final and binding.

Part 5: Fees, Payments & Refunds

Fees & Payment Terms

Evaluation program fees and any other applicable charges are displayed on our website at the time of purchase. By making a purchase, you agree that: (a) All fees are quoted and payable in the currency specified; (b) You authorize us to charge your selected payment method; (c) You are responsible for any additional fees charged by your payment provider; (d) Prices are subject to change without notice (existing purchases are honored); (e) Promotional discounts and coupon codes are subject to specific terms and expiration; (f) Subscription services, if any, will auto-renew unless cancelled. We accept various payment methods as indicated on our website. FundYourEdge is not responsible for payment failures due to insufficient funds, expired cards, or incorrect payment information.

No Refund Policy

ALL PURCHASES ARE FINAL. FUNDYOUREDGE DOES NOT OFFER REFUNDS FOR ANY PRODUCTS OR SERVICES. By making a purchase, you acknowledge and agree that: (a) All evaluation fees, subscription fees, and service fees are non-refundable; (b) No refunds will be issued for any reason, including but not limited to: - Evaluations where trades have or have not been placed; - Failed evaluations due to rule violations or loss limits; - Accounts terminated for Terms violations; - Dissatisfaction with the Services; - Change of mind or circumstances; - Technical issues on your end (internet, hardware, software); - Promotional, discounted, or full-price purchases. (c) Chargebacks or payment disputes initiated without valid grounds may result in immediate account termination and potential legal action; (d) You waive any right to seek refunds except where explicitly required by applicable law. We encourage you to carefully review all program details, trading rules, and terms before making a purchase. Contact our support team with any questions prior to purchasing.

Part 6: Website Usage

Limited License

Subject to your compliance with these Terms, FundYourEdge grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Site and Services for your personal, non-commercial use. This license does not include the right to: (a) Modify, copy, or create derivative works of the Site or its content; (b) Use any data mining, robots, or similar data gathering methods; (c) Download or copy account information for third-party benefit; (d) Use the Site or Services for any commercial purpose without authorization. This license is automatically revoked if you violate these Terms.

Prohibited Conduct

  • Using the Services for any illegal purpose or in violation of any applicable laws
  • Attempting to gain unauthorized access to any portion of the Site, other accounts, or computer systems
  • Interfering with or disrupting the Site, servers, or networks connected to the Site
  • Using any automated system, including bots, scrapers, or spiders, to access the Site
  • Impersonating any person or entity, or falsely stating or misrepresenting your affiliation
  • Transmitting any viruses, malware, or other malicious code
  • Harassing, threatening, or intimidating other users or FundYourEdge staff
  • Engaging in any activity that could damage, disable, or impair the Site
  • Circumventing any security measures or access controls
  • Using the Site to send spam or unsolicited communications
  • Reverse engineering, decompiling, or disassembling any portion of the Site
  • Sharing account credentials or allowing others to access your account

Intellectual Property

All content on the Site, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, software, and the compilation thereof (collectively, "Content"), is the property of FundYourEdge or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws. The FundYourEdge name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of FundYourEdge. You may not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans on the Site are the trademarks of their respective owners. You may not reproduce, distribute, modify, display, perform, or otherwise use any Content without our express written consent.

Part 6A: CME Market Data Terms

CME Group Market Data Terms

FundYourEdge provides access to market data from exchanges operated by CME Group Inc. ("CME Group"), including the Chicago Mercantile Exchange ("CME"), Chicago Board of Trade ("CBOT"), New York Mercantile Exchange ("NYMEX"), and Commodity Exchange, Inc. ("COMEX"). This data is provided via Third-Party Application Providers ("TPAPs") authorized by CME Group. By using our Services, you become a "Subscriber" to CME Group market data and agree to comply with all applicable CME Group market data policies. These terms are required by our Information License Agreement with CME Group and are binding on all users. IMPORTANT: Your access to CME Group market data is conditional upon your compliance with the terms in this section. Violation of these terms may result in immediate termination of your access and potential liability.

Prohibition on Data Redistribution

You shall not distribute, redistribute, publish, display, or otherwise make available any CME Group market data ("Market Data") to any third party. This includes, but is not limited to: (a) Sharing screenshots, recordings, or copies of market data with any person or entity; (b) Broadcasting or streaming market data on any platform, website, or social media; (c) Incorporating market data into any product, service, or publication for distribution; (d) Providing market data access to employees, contractors, or associates not covered under your account; (e) Allowing any person other than yourself to view or use your account's market data. Market Data is licensed solely for your personal, internal use in connection with the Services. Any unauthorized distribution constitutes a material breach of these Terms and may subject you to liability for damages and CME Group's enforcement actions.

Prohibition on Derived Works

You shall not use CME Group Market Data to create any derivative works. You may not use Market Data to create, calculate, develop, or distribute: (a) Any indices, benchmarks, or reference prices; (b) Any risk management tools, analytics, or valuation models for distribution; (c) Any tradable financial products, instruments, or contracts; (d) Any datasets, databases, or data feeds; (e) Any algorithms, signals, or automated trading systems for commercial distribution; (f) Any research reports, analyses, or publications incorporating raw market data. This restriction applies regardless of whether such derivative works would be offered for free or for a fee. Your use of Market Data is strictly limited to personal trading decisions and internal educational purposes within the FundYourEdge platform.

Professional vs. Non-Professional Status Certification

CME Group requires all subscribers to accurately certify their status as either "Professional" or "Non-Professional" for market data fee purposes. Different fee structures apply to each category. NON-PROFESSIONAL SUBSCRIBER means a natural person who: (a) Uses Market Data solely for personal, non-business use; (b) Is not registered or qualified with any securities or commodities regulatory agency or self-regulatory organization; (c) Is not employed by or associated with a broker-dealer, investment adviser, futures commission merchant, commodity trading advisor, or commodity pool operator; (d) Does not perform any functions similar to those of such registered professionals; (e) Does not use Market Data for any business or commercial purpose. PROFESSIONAL SUBSCRIBER means any person who does not qualify as a Non-Professional Subscriber. BY USING OUR SERVICES, YOU CERTIFY THAT THE INFORMATION YOU PROVIDED REGARDING YOUR PROFESSIONAL STATUS IS ACCURATE AND COMPLETE. If you are a Professional using data at Non-Professional rates, you shall be liable for the difference in fees, which may amount to several thousand dollars per month per exchange, plus any penalties assessed by CME Group. Providing false information regarding your professional status constitutes a MATERIAL BREACH of these Terms. You agree to indemnify FundYourEdge for any fees, fines, or penalties resulting from your misrepresentation of professional status.

Display-Only Use Restriction

The CME Group Market Data provided through our Services is licensed for "Display Only" purposes. This means Market Data may only be used for viewing on a screen or interface for personal trading decisions. NON-DISPLAY USE IS PROHIBITED unless you have obtained a separate license. Non-Display Use includes, but is not limited to: (a) Automated Trading: Using Market Data as input for any automated, algorithmic, or black-box trading system; (b) High-Frequency Trading: Any trading activity that relies on low-latency data processing; (c) Order Routing: Automated order management, routing, or execution systems; (d) Risk Management Systems: Automated risk calculation, position management, or portfolio systems; (e) Data Processing: Any automated processing, storage, or analysis of Market Data; (f) Price Referencing: Using Market Data prices for settlement, valuation, or contract specification. If you require Non-Display Use of CME Group Market Data, you must obtain a separate "Managed User" Non-Display license through CME Group or an authorized vendor. Contact our support team for guidance on obtaining appropriate licenses. Violation of Display-Only restrictions may result in immediate account termination and liability for Non-Display licensing fees.

No Financial or Investment Advice

Nothing on this Site or in our Services constitutes financial, investment, legal, or tax advice. All content, including educational materials, FAQs, webinars, and trading tools, is provided for informational and educational purposes only. FundYourEdge does not: - Recommend any specific trading strategy or financial instrument; - Provide personalized investment advice; - Guarantee any trading results or outcomes; - Act as a broker-dealer, investment adviser, or futures commission merchant. You are solely responsible for your own trading decisions and should consult with qualified professionals before making any financial decisions. Trading involves substantial risk and is not suitable for everyone.

Simulated Trading Environment Disclosure

IMPORTANT: FundYourEdge is an EDUCATION-BASED SIMULATED TRADING platform. All Evaluation programs are conducted in a simulated environment for EDUCATIONAL AND EVALUATION PURPOSES ONLY. PLATFORM DEFINITION: (a) FundYourEdge provides simulated trading services referencing futures contracts listed on CME Group exchanges (CME, CBOT, NYMEX, COMEX); (b) All trading activity occurs in a simulated environment using virtual funds; (c) NO trades are routed to any live exchange during Evaluation phases; (d) NO real money is deposited, invested, or at financial risk during Evaluations; (e) The platform is NOT a broker-dealer, futures commission merchant, or financial institution; (f) Users do not have accounts with any exchange or clearing house during Evaluation. SIMULATION LIMITATIONS: (a) Simulated execution may differ from live market conditions; (b) Simulated fills do not account for actual liquidity, slippage, or market impact; (c) Price data used in simulation may be delayed or adjusted; (d) Results achieved in simulation do NOT represent actual trading; (e) Past simulated performance is NOT indicative of future live trading results. Because simulated trades are not actually executed on any exchange, results may under- or over-compensate for market factors such as liquidity constraints, order book depth, slippage, and market impact. No representation is made that any account will or is likely to achieve profits or losses similar to those shown in any simulation. This definition qualifies FundYourEdge for educational market data licensing tiers. Any change to this operational model would require updated disclosures and potentially different licensing arrangements.

CFTC Rule 4.41 Hypothetical Performance Disclosure

HYPOTHETICAL OR SIMULATED PERFORMANCE RESULTS HAVE CERTAIN LIMITATIONS. UNLIKE AN ACTUAL PERFORMANCE RECORD, SIMULATED RESULTS DO NOT REPRESENT ACTUAL TRADING. ALSO, SINCE THE TRADES HAVE NOT BEEN EXECUTED, THE RESULTS MAY HAVE UNDER-OR-OVER COMPENSATED FOR THE IMPACT, IF ANY, OF CERTAIN MARKET FACTORS, SUCH AS LACK OF LIQUIDITY. SIMULATED TRADING PROGRAMS IN GENERAL ARE ALSO SUBJECT TO THE FACT THAT THEY ARE DESIGNED WITH THE BENEFIT OF HINDSIGHT. If you are offered and accept a Funded Account involving live market trading: (a) You will be trading with real capital provided by FundYourEdge; (b) Trading in live financial markets involves SUBSTANTIAL RISK; (c) You may lose some or all of the trading capital allocated to you; (d) Market conditions can change rapidly and unpredictably; (e) Technical failures, connectivity issues, and platform errors may occur; (f) Slippage, gaps, and liquidity constraints affect real market execution; (g) Past performance, whether simulated or live, does not guarantee future results. You acknowledge that you understand these risks and accept full responsibility for your trading decisions. FundYourEdge is not responsible for trading losses.

Disclaimer of Warranties

THE SITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, FUNDYOUREDGE DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO: (A) IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT; (B) WARRANTIES THAT THE SITE OR SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY INFORMATION; (D) WARRANTIES THAT DEFECTS WILL BE CORRECTED OR THAT THE SITE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FUNDYOUREDGE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, OR ASSIGNS BE LIABLE FOR: (A) ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES; (B) ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES; (C) ANY TRADING LOSSES, WHETHER IN SIMULATED OR LIVE ENVIRONMENTS; (D) ANY DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO OR USE OF YOUR ACCOUNT; (E) ANY DAMAGES RESULTING FROM INTERRUPTION OR CESSATION OF THE SERVICES; (F) ANY DAMAGES RESULTING FROM BUGS, VIRUSES, OR OTHER HARMFUL CODE; (G) ANY DAMAGES RESULTING FROM THIRD-PARTY CONTENT OR CONDUCT. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO FUNDYOUREDGE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

Indemnification

You agree to defend, indemnify, and hold harmless FundYourEdge, its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) Your use of and access to the Site and Services; (b) Your violation of any provision of these Terms; (c) Your violation of any third-party right, including intellectual property, privacy, or proprietary rights; (d) Any claim that your actions caused damage to a third party; (e) Your trading activities and decisions; (f) Any misrepresentation made by you. This indemnification obligation will survive termination of these Terms and your use of the Services.

Part 8: Legal Provisions

Governing Law

These Terms and any dispute arising out of or related to these Terms or the Services shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. You agree that any legal action or proceeding relating to these Terms shall be brought exclusively in the state or federal courts located in Wyoming, and you hereby consent to the personal jurisdiction and venue of such courts.

Dispute Resolution & Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS. Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Commercial Arbitration Rules. The arbitration shall be held in Sheridan County, Wyoming, and conducted in English. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court having jurisdiction. EXCEPTIONS: FundYourEdge may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights. Either party may bring claims in small claims court if the claim qualifies.

Class Action Waiver

YOU AND FUNDYOUREDGE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. Unless both you and FundYourEdge agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding. If this class action waiver is found to be unenforceable, then the entirety of the arbitration agreement shall be null and void, and the dispute shall proceed in court.

CME Group Exchange Jurisdiction

By using our Services and initiating any transaction—whether simulated or live—that references products listed on CME Group exchanges (CME, CBOT, NYMEX, COMEX), you acknowledge and agree to the following: CONSENT TO JURISDICTION: (a) You consent to the jurisdiction of CME Group and its constituent exchanges for matters relating to your use of CME Group market data and referenced products; (b) You agree to be bound by all applicable CME Group rules, policies, and procedures; (c) You acknowledge that CME Group may take enforcement action against you for violations of its rules, even in a simulated environment; (d) You consent to cooperate with any CME Group investigation or inquiry regarding your trading activity or use of market data. APPLICABILITY: This consent applies regardless of whether your trading activity occurs in a simulated or live environment. CME Group maintains jurisdiction over the integrity of its markets and market data, and violations—even in simulation—may burden CME Group systems or violate data licensing terms. CME Rule 575 - Disruptive Practices Prohibition

Even in a simulated trading environment, you agree to comply with the principles of CME Rule 575 (Disruptive Practices Prohibited). The following practices are STRICTLY PROHIBITED: SPOOFING (Rule 575.A): Entering orders with the intent to cancel before execution, or entering orders to create a misleading appearance of market depth or interest. This includes: (a) Placing large orders with no intention to execute; (b) Layering orders on one side of the market to move prices; (c) Canceling orders immediately after placement to manipulate perception. LATENCY ARBITRAGE: Exploiting the speed difference between the market data feed and the simulation engine to gain unfair advantage. This includes: (a) Using external data feeds faster than the platform's simulation feed; (b) Employing software designed to detect and exploit latency differences; (c) Timing trades based on anticipated data feed delays. DATA FEED MANIPULATION: Any activity intended to slow down, corrupt, or exploit the market data feed, including: (a) Flooding the platform with excessive requests or orders; (b) Attempting to cause data feed errors or delays; (c) Reverse engineering the simulation engine or data processing systems. WASH TRADING: Entering transactions where there is no change in beneficial ownership, including: (a) Trading against yourself across multiple accounts; (b) Pre-arranged trading with others to simulate volume; (c) Any trading activity designed to artificially inflate metrics. CONSEQUENCE: Violation of these rules, even in simulation, may result in immediate account termination, forfeiture of any pending payouts, and referral to CME Group for potential enforcement action. You may be permanently banned from our platform and reported to relevant regulatory authorities.

CME Group Third-Party Beneficiary Rights

You acknowledge and agree that CME Group Inc. and its affiliates, including but not limited to the Chicago Mercantile Exchange Inc., Board of Trade of the City of Chicago, Inc., New York Mercantile Exchange, Inc., and Commodity Exchange, Inc. (collectively, "CME Parties"), are intended THIRD-PARTY BENEFICIARIES of this Agreement with respect to the Market Data provisions. ENFORCEMENT RIGHTS: (a) The CME Parties have the right to enforce the Market Data terms of this Agreement directly against you; (b) The CME Parties may pursue legal remedies against you independently of FundYourEdge; (c) You waive any defense based on lack of privity of contract with CME Parties; (d) This third-party beneficiary status survives termination of your account. DIRECT LIABILITY: If you violate any Market Data terms (including redistribution, derived works, professional status misrepresentation, or non-display use restrictions), CME Group may: (a) Pursue damages directly against you; (b) Seek injunctive relief in any court of competent jurisdiction; (c) Require FundYourEdge to terminate your access immediately; (d) Assess penalties and fees for unauthorized use. Your agreement to these third-party beneficiary rights is a condition of your access to CME Group Market Data through our Services.

Audit Rights & Data Sharing

To ensure compliance with CME Group market data policies and these Terms, you agree to the following audit and data sharing provisions: AUDIT RIGHTS: (a) FundYourEdge reserves the right to audit your trading activity, account usage, and compliance with these Terms at any time; (b) You agree to provide reasonable cooperation with any audit, including responding to inquiries within five (5) business days; (c) Audits may be conducted without prior notice if FundYourEdge suspects a violation of these Terms or CME Group policies. DATA SHARING WITH CME GROUP: (a) You consent to FundYourEdge sharing your personal information, trading logs, account data, and activity records with CME Group if requested for a compliance investigation; (b) This consent covers any inquiry related to market data usage, disruptive trading practices, or professional status verification; (c) FundYourEdge may share data proactively if we identify potential violations of CME Group rules; (d) Where required by law, FundYourEdge will obtain any necessary consent for sharing Personal Data with CME Group. RECORD RETENTION: (a) FundYourEdge maintains records of all trading activity for the period required by CME Group and applicable regulations; (b) You agree that these records may be produced in response to CME Group inquiries, regulatory requests, or legal process; (c) You waive any objection to the production of such records for compliance purposes. Your use of our Services constitutes consent to these audit and data sharing provisions.

CME Group Limitation of Liability

You acknowledge and agree that CME GROUP INC. AND ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONSULTANTS, LICENSORS, AND THIRD-PARTY DATA PROVIDERS (COLLECTIVELY, "CME PARTIES") SHALL HAVE NO LIABILITY FOR: (a) Any errors, omissions, interruptions, delays, or inaccuracies in CME Group Market Data; (b) Any decision made or action taken by you in reliance on Market Data; (c) Any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use Market Data; (d) Any loss of profits, loss of trading opportunities, or trading losses; (e) Any failures, delays, or errors in the FundYourEdge platform or Services; (f) Any suspension or termination of your access to Market Data. THE CME PARTIES PROVIDE MARKET DATA ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. THE FOREGOING LIMITATIONS APPLY REGARDLESS OF THE CAUSE OF ACTION, WHETHER IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, AND EVEN IF THE CME PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. This limitation of liability for CME Parties is a material term of this Agreement and a condition of your access to CME Group Market Data.

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other provision of these Terms. The invalid, illegal, or unenforceable provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving the parties' original intent.

Entire Agreement

These Terms, together with the Privacy Policy and any other agreements expressly incorporated by reference herein, constitute the entire agreement between you and FundYourEdge concerning the subject matter hereof. These Terms supersede all prior or contemporaneous communications, proposals, and agreements, whether electronic, oral, or written, between you and FundYourEdge with respect to the Services. Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.

Modifications to Terms

FundYourEdge reserves the right to modify these Terms at any time in our sole discretion. When we make material changes, we will: (a) Update the "Last Updated" date at the top of these Terms; (b) Provide notice via email, website announcement, or account dashboard notification; (c) Give you a reasonable opportunity to review the changes before they take effect. Your continued use of the Services after the effective date of any modifications constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Services and may request account closure.
